Samuel Beckett Bridge Operation and Maintenance Control System Software Contract

Dublin City Council gives notice to invoke Article 32.2 (b) (ii) and (iii) for a derogation from tendering for the provision of the Samuel Beckett Bridge Operation and Maintenance Control System Software Contract for technical reasons and reasons associated with the protection of exclusive rights [specifically intellectual property rights of the software]. The key elements of the Control System Software Contract include: • Maintenance of the control system software such that it is always available for use. • Provision of a back-up copy of the software. • Provide comprehensive training and knowledge transfer to the Main O&M Contractor (and Dublin City Council staff) in the operation of and risks associated with the bridge including provision of a bridge simulator and a comprehensive Operators Manual. • Remote monitoring and support to the Main O&M Contractor during all operations. • Onsite operation of the bridge during six monthly maintenance in Maintenance Mode. Lot 1: Dublin City Council’s proposed procurement strategy in respect of future operation and maintenance requirements for the Samuel Beckett Bridge includes for the provision of two separate contracts of a five year duration and both running in parallel with each other, as follows: • Main Operation and Maintenance Contract – covers the majority of operation and maintenance requirements except maintenance relating to the control system software. • Control System Software Contract – covers maintenance of the bespoke control system software developed for the bridge and support during openings and operation of the bridge. The Main Operation and Maintenance Contract will be procured under Open Procedure of Directive 2014/24/EU. The Control System Software Contract is the subject of this VEAT notice and is being awarded under a negotiated procedure without prior publication for technical reasons and reasons associated with the protection of exclusive rights [specifically intellectual property rights of the software] in accordance with Article 32.2 (b) (ii) and (iii) of Public Sector Directive 2014/24/EU. The Control System Software Contract will cover maintenance of the control system software and operational support to the Main Operation and Maintenance (O&M) Contractor as follows: • Maintenance of the control system software such that it is always available for operational use including such upgrades as may be necessary to interface with new operating systems, software and hardware as required. • Provision of an on-site back-up copy of the control system software. • Make software changes to correct problems found upon direction of Dublin City Council. • Training and knowledge transfer to the Main O&M Contractor (and Dublin City Council staff) in respect of bridge risks and operation of the bridge in Maintenance Mode to include; a) Basic operators training every 3 years in the three main operation modes; automatic, semi-automatic and emergency b) Training in the operation of the bridge in Maintenance Mode c) Provision of a bridge simulator for all operation modes d) Provision of a comprehensive Operators Manual covering all steps in all modes including Maintenance Mode • Remote monitoring and support to the Main O&M Contractor during all planned (170 No.) and unplanned operations of the bridge. • Onsite operation of the bridge (10 No.) during six monthly maintenance in Maintenance Mode as required.
