Tender description

The contracting authority has identified a need to modify the term of its current contract for the supply of third party technical support contract for SAP by extending such term for a period of one year in accordance with Regulation 72(1)(c) of the Public Contracts Regulations 2015 (PCR 2015). The contracting authority’s intention to procure a replacement contract for the supply of third party technical support for SAP by one year. This includes support to HR, payroll, finance, procurement modules employee/manager self service, budget monitoring and forecasting functionality and to provide BASIS support for the SAP landscape services has been frustrated by the occurrence of the Coronavirus Pandemic which has resulted in the diversion of contracting authority resources to urgent operational priorities, consequently preventing it from carrying out the essential technical planning work that is required in order to procure a replacement SAP technical support service in the time available. Although the proposed contract extension fulfils the criteria set out in Regulation 72(1)(c) PCR 2015 for modifying a contract without a new procurement procedure under PCR 2015 being necessary, the contracting authority has published this Voluntary Ex Ante Transparency (VEAT) notice in order to promote transparency Although a new procurement procedure in accordance with PCR 2015 is not required given that the proposed contract modification could not have been foreseen; does not alter the overall nature of the contract; and will not result in an increase in price which exceeds 50 % of the value of the original contract as prescribed under Regulation 72(1)(c) PCR 2015, this Voluntary Ex Ante Transparency (VEAT) notice has been published to promote transparency and to indicate that the contracting authority intends to extend the term of its current contract for the supply of 3rd party technical support of SAP for one year in order to provide it with an opportunity to carry out the essential technical planning work required in order to procure a replacement contract no later than December 2021
