Tender description
Lot 1: The London Borough of Merton is seeking a partner (or partners) to enter a contract to manage, operate and maintain a number of existing leisure and community facilities (‘the Existing Facilities’) together with a possible new facility (or facilities) replacing one of the Existing Facilities (‘the Proposed Facility’). The existing facilities comprise of the following leisure facilities and community facilities: Canons Leisure Centre, Madeira Road,Mitcham, CR4 4HD (which may also include a separate hall facility at this site know as Madeira Hall); MordenPark Pool, London Road, Morden SM4 5HE; and Wimbledon Leisure Centre, Latimer Road, Wimbledon, SW191EW (together ‘the Leisure Facilities’); together with Merton Hall, 78 Kingston Road, SW19 1LA; and Morden Assembly Hall, Tudor Drive, Morden SM4 4PJ (together ‘the Community Facilities’). The proposed facility is expected to be a new facility (or facilities) designed to replace the existing Morden Park Pool facility. The final details of the Proposed Facility has yet to be finalised but it is expected to have similar types of facilities to Morden Park Pool. The Council proposes to compete the award of a 15-year contract in relation to managing,operating and maintaining the leisure facilities with options (exercisable by the Council during this term) to require the partner to manage, operate and maintain the community facilities and/or the proposed facility (such additional requirements to be performed within the 15 year term). It is estimated that the services in respect of the proposed facility (if the option is exercised) will commence in the third to fifth year of the 15-year term. The 15-year contract term is subject to an option to extend for an additional 2 years at the discretion of the Council (including as to the facilities to include in the extended term). The partner may also be required to provide some transitional services in relation to coordinating the closure of the existing Morden Park Pool and the establishment of the operation of the proposed facility. It is expected that the Transfer of Undertakings (Protection of Employment) Regulations 2006 (‘TUPE’) will apply to the award of this contract and that staff may transfer to an incoming provider. Bidders are expected to seek independent legal advice on the application of TUPE in these arrangements. Further details will be provided in the descriptive document and other procurement documents. The Council reserves the right not to award the opportunity, or to award only part of the opportunity described in this notice, or to vary the final configuration and content of the opportunity involving the existing facilities and the proposed facility.
