Tender description

This development agreement relates to the construction of 55 dwellings comprising 4 x 1 bed apartments, 7 x 2 bed bungalows, 21 x 2 bed houses, 22 x 3 bed houses and a 1 x 4 bed house, all with associated parking, on Land at Trecerus Farm, Padstow, Cornwall, PL28 8RT and the acquisition by Cornwall Council of the Land on which the dwellings will be constructed. The 55 residential dwellings will comprise 28 affordable homes and 27 open market dwellings. The development agreement is being entered into by Cornwall Council for the purposes of providing a mix of affordable and open market housing that will support to existing and future needs of the local community. The Cornwall Local Plan 2010-2030 Strategic Policy 2a sets out the key target provision of a residual 1000 dwellings for the Wadebridge and Padstow Community Network Area in the period up to 2030. This notice has been issued voluntarily. Cornwall Council believes that it can enter into the development agreement with Poltair Developments Limited using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 32 (2) (b) (ii) and/or (iii) of the Public Contracts Regulations 2015 (SI 2015/102). Poltair Developments Ltd has a call option over the Land at Trecerus Farm, Padstow and will acquire the freehold of the Land following the exercise of that option. Cornwall Council intends to enter into the Development Agreement with Poltair Developments Limited and acquire the Land on which the dwellings will be constructed. The Development Agreement can only be entered into with that particular economic operator on the basis that competition is absent for technical reasons and/or due to the protection of the economic operator’s exclusive rights to the land. The economic operator has a call option over the land and following the exercise of that option will acquire the land.
