Tender description

The development agreement relates to the construction of 67 affordable dwellings, comprising 15 x 2 bed houses, 44 x 3 bed houses and 8 x 4 bed houses with associated parking and/or garages on Land at Hay Common, Launceston, Cornwall, PL15 9FW and the acquisition of the constructed dwellings by Cornwall Council. The development agreement is being entered into by Cornwall Council for the purposes of providing affordable housing that will support the existing and future needs of the local community. The Cornwall local plan establishes Launceston as the main settlement in the community network area with good employment and transport provision. The local plan strategic Policy 2a sets out the key target provision of 1 800 dwellings for Launceston in the period up to 2030. The Cornwall Site Allocations Development Plan refers to the target for Launceston set out in the local plan and sets a series of localised objectives for Launceston, including the delivery of a range of housing stock and mixed communities, providing housing that will support the existing and future needs of the local community (including locally affordable housing). The development plan refers to permitted development at Hay Common. This notice has been issued voluntarily. Cornwall Council believes that it can enter into the development agreement with Hay Common Ltd using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 32 (2) (b) (ii) and/or (iii) of the Public Contracts Regulations 2015 (SI 2015/102). The freehold of the Land at Hay Common is owned by Hay Common Developments Ltd. Therefore, the development agreement can only be entered into with that particular economic operator on the basis that competition is absent for technical reasons and/or due to the protection of the economic operator’s exclusive rights to the Land.
