Tender description

This is a contract for the provision to Warwick District Council of pre-construction services, including design services, in relation to refurbishment and extension works to the Newbold Comyn and St Nicholas Park Leisure Centres. The Pre-Construction Services Contract awarded contained an option for Warwick District Council to award the contractor a design and build contract in respect of the above mentioned refurbishment and extension works using an NEC3 ECC Option A contract. Warwick District Council has exercised that option and has awarded the construction contract (which is the subject of a separate contract award notice). The procurement was carried out under the competitive procedure with negotiation, the negotiation being in relation to design risk only. It was the Council's strong preference that the contractor should take all design risk, however it was not a minimum requirement. Therefore, in accordance with Regulation 29(2)(b) of the Public Contracts Regulations 2015, the elements of the description which defined the minimum requirements were everything in the documents apart from the design risk. The council also allowed for an award of the Pre-Construction Services Agreement based on initial tender responses, without having to undertake any negotiation.
