Tender description
The intention of the project is to ensure the Contracting Authority is compliant with the Safer Detention and Handling of Prisoners (‘SDHP’) Guidelines. The project comprises 2 distinct elements: alterations and remedial works under an intermediate building contract (with contractor's design), including the installation and testing of replacement CCTV and Suspect Digital Interview (‘SDI’) systems at 5 sites (see II.2.3)) (‘Construction phase’), and support and maintenance services in respect of CCTV and SDI systems (‘IT phase’). The contractor (as detailed in V.2.3)) will deliver the Construction phase and oversee the delivery of the IT phase by way of a sub-contract. Once the Construction phase is complete, the IT sub-contract will be novated so the Contracting Authority will assume the obligations of the contractor. The IT sub-contract will be for 5 years (with a possible extension of up to 2 years) and will commence from when the construction works at the 1st site are completed. The Contracting Authority commenced an Open Procedure procurement for repairs to county-wide custody suites (SDHP3), CCTV replacement and suspect digital interview. The Contracting Authority concluded that as a result of a lack of suitable tenders in relation to the criteria set out in the Invitation to Tender (‘ITT’), the Contracting Authority would be unable to ensure genuine competition. Accordingly the Contracting Authority decided to discontinue the Open Procedure and under Regulation 32 (2) (a) of the Public Contracts Regulations 2015 (the ‘Regulations’) to continue the procurement using the Negotiated Procedure without publication of a further contract notice in the Supplement to the Official Journal of the European Union.
