Additional information: The incumbent supplier/provider has informed the Council that it does not currently believe that any of its employees will be eligible to transfer to the new supplier/provider in accordance with TUPE. However bidders must satisfy themselves as to whether any obligations or liabilities will arise. The application of TUPE will always be a matter of fact based on the individual circumstances of the particular transfer and particular employee and Bidders should seek their own legal advice.
