Supply and Delivery of DNA Consumables and Maintenance of existing equipment Contract through NCA: An NCA can be justified under Public Contracts (Scotland) Regulations 2015: Regulation 33 (1) (b) (ii) and (iii) of the Public Contracts (Scotland) Regulations 2015, which allows the contracting authority to award a public contract without prior publication of a contract notice or prior information notice when (ii) Competition is absent for technical reasons (iii) the protection of exclusive rights, including intellectual property rights, but only where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
