23/032 - Arc GIS Enterprise Licencing Agreement

Tender description

The Contracting Entity, Uisce Eireann require Arc GIS Software and associated licences in respect of a range of Arc GIS Products & Technologies (listed in this notice) that are used to underpin IT applications currently hosted by the Contracting Entity. The complexity of the Contracting Entity’s environment and its dependency on Arc GIS Products & Technologies requires Licencing which is aligned directly to the software provider. These technologies are only available directly from Esri Ireland who own the sole distribution rights in Ireland. Uisce Eireann is seeking to award a contract for a five year period commencing 19th December 2023 to Esri Ireland for the continued access to the aforementioned Arc GIS Technologies and Products. Lot 1: Uisce Eireann intends to award the contract to Esri Ireland for Arc GIS Technology and Products Software Licencing (including updates) on the basis of the negotiated procedure without prior publication of a contract notice pursuant to Article 50(c)(iii) of Directive 2014/25/EU for tender reference 23/032, on the basis that Esri Ireland is the only economic operator capable of providing such Licencing (on the basis of Esri Inc. exclusivity rights, and granting sole distribution rights in Ireland to Esri Ireland). Esri alone has the specific technical knowledge and skills necessary to undertake the services as they own and have developed the relevant software Products and Technologies used by the Contracting Entity in connection with its operations. The scope of the Licencing Agreement includes, an Enterprise Licencing agreement for all Arc GIS Technologies and Products (and any new products that may come on line during the course of the Agreement) as follows but not limited to ; • Arc GIS Desktop • Arc GIS Pro • Arc GIS On line • Arc GIS Enterprise Environments • Drone 2 Map • Insights • City Engine • Utility NM • Data Interoperability • Arc GIS Extensions • Enterprise Optional Servers • Mapping & Charting • Arc GIS Engine & Extensions • Arc GIS Run Time • Arc Monitor • Arc GIS Data Reviewer for Server Extensions.
