Herefordshire and Worcestershire Integrated Waste Management Contract

Tender description

This notice relates to a permitted modification to a contract originally awarded in Dec. 1998 and involves (i) an extension of 5 years to the contract;(ii) alternative disposal obligations in respect of food, garden paper and cardboard waste to meet Herefordshire Council's (HC) future waste collection model, (iii) inclusion of the right of HC to require additional waste to be processed at the Waste to Energy facility at an agreed commercial rate. The amendments will be validly made and the Councils' decisions in relation to the modification are in the public domain. Item (i) above is within the scope of the original published contract notice, is permitted under regulation 72(1)(e) of the Public Contracts Regulations 2015 (PCR) and does not amount to a new contract. Items (ii) and (iii) above are also not substantial (as permitted by Regulation 72(1)(e) of PCR) and the variations do not amount to a new contract. In addition, item (ii) is permitted under regulation 72(1)(f) of PCR. Lot 1: This VEAT notice relates to the permitted modification of an integrated contract which comprises the design, construction financing and operation of facilities to receive, process, dispose of and/or recycle municipal solid waste generated within the counties of Herefordshire and Worcestershire for a period of between 15 and 30 years. The original contract was awarded in December 1998 following a negotiated procedure procurement, and was subject to a permitted modification in 2014.
