SC21081 Traffic Management Act Part 6 – Moving Traffic Enforcement

This is a Prior Information Notice to notify Contractors of our intention to procure the following from Spring 2022 The Traffic Management Act 2004 introduced civil enforcement of traffic offences in England and Wales. Part 6 of the Act allows councils outside of London to enforce moving traffic offences, like making banned turns, exceeding weight limits and stopping in yellow box junctions. Despite the 2004 Act now being 17 years old, the legislation has never been introduced to parliament and these moving traffic contraventions can only be enforced by the police under criminal law. This is about to change. In September 2020 the Department for Transport (DfT) announced that they would be fully enacting the remaining elements of the Traffic Management Act, permitting local highway authorities outside of London to use approved camera devices to enforce moving traffic contraventions. Kent County Council (KCC) is preparing itself and the highway infrastructure for these powers. The first step is for KCC to apply to the DfT to be included in the list of authorities that can enforce the law. Once the Act has been passed by Parliament, these powers will be granted to KCC to be used across Kent. This is likely to be in the summer of 2022. The second step will be for KCC to procure the optimum service to undertake enforcement. KCC’s preferred option is for a single end-to-end service provider contract for a period of 5 years to include the following: 1. Provision of ANPR devices (potentially 50 over five years) and associated equipment from one of the four suppliers that have been granted certification for their ANPR enforcement technology relating to TMA P6 legislation; provision of approximately 10 dummy cameras; provision of a mobile vehicle with mounted ANPR camera system; provision of air quality monitoring equipment at each site. 2. Provision of ALL Back-office management systems: a. ANPR artificial intelligence capture b. DVLA look up c. Evidence Pack review d. Penalty Charge Notice system e. Debt recovery system 3. Provision of all resources and staff to establish and manage the whole system. Delivery of the project will enable KCC to enforce moving traffic offences to allow reallocation of Kent Police’s resources, address congestion and safety concerns and improve air quality at key junctions across Kent. Lot 1: Procurement process: It is our current intention to use the Competitive Procedure with Negotiation for the procurement process, although this will be confirmed in 2022 as part of our Commercial Strategy. The Selection Questionnaire will be released in early Spring 2022, with the ITT following this later in the year. Further details will be released via the Kent Business Portal. Market engagement: As part of this process, we intend to conduct some market engagement meetings in the week commencing 10 January 2022. We will send invites to these meetings based on responses to the below question. Please express an interest in this opportunity, and then provide your response to the following via the Messages facility on the Kent Business Portal: Expressions of interest should include reference to any previous experience in this field or similar, and technical proposals for on-street enforcement and back-office system. We intend to invite suitable candidates for a discussion in January 2022. Budget: Estimate contract cost £5.2m.
