Wellsky JAC (formerly JAC) has exclusive rights for software maintenance and support including associated interfaces (PAS, Pharmacy Robots, General Ledger, Accounts Payable, TPN/CIVAS) and CACHE Licences. Software maintenance and support is inclusive of the manufacturing and trading software. Included as part of the support charges and warranty of the software Wellsky JAC will amend the JAC application software so that the JAC application software complies with any legal requirements pertaining to the operation of the software for its intended purpose. No other reasonable alternative exists for this procurement — this is a complex system that is critical to patient care and service delivery. Wellsky JAC are the sole supplier and have exclusive rights over the software, licences and updates for this system. The absence of competition is not a result of artificial narrowing of the parameters of the procurement. This system will be replaced as a core element of the HSCNI Regional Encompass Programme, which will introduce digital integrated care pathways to Northern Ireland. This contract is required to cover the transitional period and a replacement in the short-term is not a reasonable alternative as it would require extensive ICT infrastructure, validation and integration work that would result in significant disruption and disproportionate technical difficulties that would impact on the Trusts ability to provide a Pharmacy service.
