Superdispersant 25 Replacement

Tender description

The purchase of Superdispersant 25 delivered to MCA National Dispersant Stockpile as a result of existing stock failing efficacy tests rendering them redundant therefore are not attributable to the Contracting Authority. Single tender action in the instance of this purchase has been justified under Public Contract Regulation 32 5 (b), negotiated procedure without prior publication may be used for public supply contracts as the goods being procured are for additional deliveries by the original supplier which are intended either as a partial replacement of supplies, or installations or as the extension of existing supplies or installations where a change of supplier would oblige the Contracting Authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
