Tender description
Legal advice is required to support the Department on the design and delivery of further phases of the SRESS, namely export tariff for exporting focused projects (rather than the renewable self-consumers that are covered by grants in phase one): • Provide legal advice during the design phase of the SRESS • The legal drafting and review of the SRESS Terms and Conditions and any supporting documents. • Advice relating to queries relating to the Terms and Conditions. • Legal review of the Terms and Conditions to ensure consistency with the provision of the EU Recast Renewable Energy Directive, on any potential State Aid notification and general compliance with State Aid rules, to include State Aid rules as they relate to undertakings involved in Agriculture; • Legal review of the Terms and Conditions in order to ensure consistency, as appropriate, with RESS and other support schemes, in particular for Community Energy issues. • Successful tenderer will also be required to engage with the Commission for the Regulation for Utilities (CRU) and EirGrid regarding their specific roles related to the SRESS as appropriate; • In addition to the above, ad hoc legal advice may be required to support the Department from time to time during the design and implementation processes as the policy context evolves. Furthermore, it is expected that the successful tenderer will: • review, legally proof and assist with drafting where necessary of all relevant documents • where required, attend at meetings/videoconferences • where required, attend and participate in person or by video or teleconference meetings of the DECC SRESS design and implementation project team and steering group • provide any other advice and assistance which would reasonably be expected to be required in relation to this service Lot 1: External Legal Advisory services required to support DECC with the Small Scale Renewable Electricty Scheme
