Strategic Environmental Assessment, Appropriate Assessment, and ‘Do No Significant Harm’ Assessment for the EU Just Transition Fund Programme 2021-2027

Tender description

The Eastern and Midland Regional Assembly is seeking tenders from suitably qualified and experienced environmental consultants to carry out the following services for the proposed EU Just Transition Fund Programme: • A Strategic Environmental Assessment and which fully complies with the principles and requirement of the SEA Directive 2001/42/EC, European Communities (Environmental Assessment of Certain Plans and Programmes) Regulations 2004 (S.I. 435 of 2004) and S.I. No. 436 of 2004 (Planning and Development (Strategic Environmental Assessment) Regulations 2004 as amended by S.I. No. 200 of 2011 (European Communities (Environmental Assessment of Certain Plans and Programmes) (Amendment) Regulations 2011) and S.I. No. 201 of 2011 (Planning and Development (Strategic Environmental Assessment) (Amendment) Regulations 2011) respectively. • As part of the SEA, screening for Regional Level Flood Risk Appraisal (RFRA) and, where required, additional stages of RFRA in accordance with the requirements and guidance set out in theDepartment of Housing, Planning, Community and Local Government Guidelines for Planning Authorities No. 20: "The Planning System and Flood Risk Management". • Screening for Appropriate Assessment and, where required, additional stages of AA as necessary, under the European Communities (1992) Council Directive 92/43/EEC on the Conservation of Natural Habitats and Wild Flora and Fauna (the Habitats Directive) and SI No.477/2011 European Communities (Birds and Natural Habitats) Regulations 2011, Regulation 42 of which requires any plan or project by a public authority to screen for AA • To carry out an assessment for “Do no Significant Harm” (DNSH) under the Recovery and Resilience Facility Regulation (EU) 2021/241 that requires that no measure (i.e. no reform and no investment) included in a Member States’ Recovery and Resilience Plan (RRP) should lead to significant harm to any of the six environmental objectives within the meaning of Article 17
