Under Regulation 6 (1) (b) (ii) of the Procurement (Scotland) Regulations 2016, a contracting authority may use the negotiated procedure without the prior publication in the case of a public contract, based on the following justification: Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists). Life Cast Body Simulation is the only company on the market to produce these specific equipment devices and parts – specifically the realistic nature of the models and Bluetooth speaker used to familiarise students with different accents and dialects.
