Environmental Impairment Liability Insurance (EIL) for a Private Finance Initiative (PFI) waste management services contract

Wrexham County Borough Council (WCBC) is seeking to engage the market for an Insurance Broker, required to place Environmental Impairment Liability Insurance (EIL) for a Private Finance Initiative (PFI) waste management services contract, with multiple insured parties. Sites Phase 1 (P1) Wrexham Recycling Park, Bryn Lane, Wrexham LL13 9UT incorporating - Materials Recycling Facility (MRF) - In-vessel composting (IVC) - Transfer Station - Education Room and offices - Household Recycling Centre To also include two other Household Recycling Centres at - The Lodge, Brymbo, Wrexham LL11 5NR - Wynnstay Bank, Plas Madoc, Wrexham LL14 3ES Phase 2 (P2) - Mechanical Biological Treatment facility (MBT) - P2 Dewatered Street Cleansing Waste treatment works Cover To indemnify the Insureds in respect of all sums that may become legally liable to pay (including claimant’s costs and expenses) as damages in respect of claims arising during the period of insurance for:- - Third party property damage - Death, or bodily injury, illness, disease contracted by any person - Remediation/clean up costs for environmental damage - Emergency expense to mitigate and/or reduce loss and/or costs - Voluntary clean up costs where, if such costs are not incurred, the insured will receive a claim, remediation notice or other written demand or notice asserting liability or responsibility on the part of the insured, and Arising from and/or related to: - New contamination since handover - Aggravation of existing contamination (historic) resulting from development and/or use of the P1 and P2 sites Insurer Security Required is a claims-paying rating from S&P Global Ratings (previously Standard & Poor’s) of at least A-, or an equivalent rating with any other rating agency (subject to approval). Term Ideally 10-year cover but will consider 5-year, to commence - Historic pre-existing conditions - May 22 - New conditions P1 – October 22 - New conditions P2 – March 23 This is a PIN notice only, to determine interest in arranging EIL insurance cover for WCBC under its PFI waste management service contract.
