Regulation 32 exempt: 32(2)(b)(ii) whereby competition is absent for technical reasons. HSE asserts its belief that Niall Evans is the only economic operator in the EU that is capable of supporting HSE in respect of COSHH training delivery in accordance with the requirement to maintain their evidential integrity. HSE has previously been to market in October 2021 for the delivery of the same services and Capita were the only economic operators to submit a bid. HSE did not believe Capita met the required standards of delivery and subsequently Capita have confirmed that it would not bid if this contract were to be competitively tendered again and HSE has no knowledge of any new entrants to the market, nor does it consider that there are any economic operators who did not bid last time that would be capable of meeting its requirements at present and consequently asserts general grounds are satisfied.
