Maintenance of information technology software

Tender description

This notice relates to the award of a contract on a 3-year rolling basis for Payroll and HR IT system maintenance. Arun District Council owns a perpetual licence for the software in question but this does not include regular essential system maintenance and upgrades. This contract is to cove that element of the IT system. The Council has previously purchased a perpetual licence for the Payroll and HR IT system known as SumTotal, in effect owning the software outright. However, this licence does not include system maintenance and a separate contract is required for this. It is this maintenance contract which the Council proposes to enter into. The contract will be for approximately GBP 34 000 per annum on a 3-year rolling basis with an effective notice period of 2 years. It is therefore estimated that the total contract value may exceed the EU threshold if the Council retains it for more than 5 years. SumTotal is the ultimate intellectual property owner of the software and has not licenced any other organisation to provide maintenance for this system. Therefore this contract can only be awarded to SumTotal and competition for the maintenance services is absent. Accordingly this contract is awarded in accordance with Regulation 32(2)(ii).
