Tender description

The State Laboratory intend to invoke Article 32 for a derogation from tendering for the purchase of a high resolution, accurate mass, liquid chromatograph tandem mass spectrometer system for small molecule analysis in complex biological matrices. Market research undertaken by the State Laboratory shows there is only one technology capable of this. The technology is patented and there is only one supplier to Ireland. Competition is absent for technical reasons which is a case provided for in Section 2 (b) (ii) of Article 32 of Directive 2014/24/EU.
