Tender description

This contract provides for the conditional purchase by the Council of land and residential units at Burnet Lane, Kingsworthy (‘the Property’). This contract provides for the conditional purchase by the Council of land and residential units at Burnet Lane, Kingsworthy (‘the Property’) under which: — Drew Smith Limited (‘the Seller’) is the owner of the property, — the seller has designed and specified the development of the property, and — the seller is under no obligation to carry out the development works at all, but if it does so (in accordance with the contract), the Council will buy the property on the terms set out in the contract. This contract is a public service contract for the acquisition of land pursuant to Regulation 10(1), Public Contracts Regulations 2015. As such, the contract falls outside the scope of and does not need to comply with Part 2 of the Public Contracts Regulations 2015 (and therefore Directive 2014/24/EU) and may be awarded without prior publication of a contract notice in the Official Journal of the European Union.
