Tender description
Leeds railway station is the busiest in the north of England, and projects an increase in footfall of 49 % by 2023 and 135 % by 2043. Leeds City Council wishes to support the redevelopment of the station and its immediate surrounds. This redevelopment and regeneration is critical to supporting the Council’s Inclusive Growth Strategy call for 21st century infrastructure to support the growth of the city and region (creating jobs and social/economic development). To do this, the Council is working in co-operation with Network Rail, Northern Powerhouse Rail, HS2, West Yorkshire Combined Authority and London and Continental Railways (LCR). LCR is a UK Government (DfT) owned company which specialises in railway led regeneration and has a skill set which is not available within the Council but is complementary to the Council’s expertise and leadership role in driving forward regeneration. In addition, LCR has unique access to Network Rail and DfT to support and promote the Council’s ambitions. The procurement: (a) provides the contractual framework for an overarching, strategic contractual joint venture between the Council and LCR in order to work together to deliver the parties objectives referred to above (Tier 1). At a second level below the Joint Venture Agreement (Tier 2), a limited partnership is anticipated to be formed which will structure the relationship between LCC and LCR in respect of specific sites, which are to be acquired under the joint venture arrangements in accordance with business plan where both parties will identify their resource commitments, programme of work and costs together with an outline 3 year plan to show forward programme and strategy; (b) provides for the establishment of additional joint ventures or other appropriate arms’ length commercial arrangements with other third parties (Third Parties) in order to deliver discrete phases or elements of the project and/or developments of additional sites through SPJVs, including with Network Rail in respect of the station; (c) identifies the parties respective contributions (including financial) and proportionate share of returns (initially 50:50, but adjusted to reflect actual contributions), and provides for payment of 141 000 GBP of LCR costs to date. It is anticipated that the joint venture arrangements will be in place for 20 years, reflecting the timeline for the delivery of HS2 and Northern Powerhouse Rail (though they may be terminated earlier if the joint venture is unsuccessful, or extended by 10 years if successful).
