Tender description
Norfolk County Council wishes to procure an open Framework Agreement with a range of providers to deliver 1:1 personal tuition and on-line tutorial services to children and young people aged 5-18 (up to 25 for pupils with EHC plans). This is a Light Touch Regime Framework Agreement being let under Regulations 74 to 77 of the Public Contract Regulations 2015 (as amended), under which the Council has flexibility regarding the process or procedure to be used when purchasing certain services, which includes these services. In this instance, the Council is establishing a Framework Agreement with multiple suppliers that will set out the terms and conditions for buying specific services. The Framework Agreement differs from those let under the non-light touch regime in that the Council, exercising its flexibility, will keep the Framework open for new applicants. It is the Council’s intention that new providers will be able to apply to join the framework on an open basis. The aim of the framework and this lot is to assist us in meeting our duties as outlined below: — Section 19 Education Act 1996: to deliver full time education to pupils of statutory school age who due to exclusion, illness or other reason may not receive full time education, — Section 61 Children and Families Act: a local authority may arrange for any special educational provision it has decided us necessary for a child or young person for whom it is responsible to be made otherwise than in a school or post 16 institution, — to secure sufficient suitable education and training provision and enable the participation in education and training of 16-18 years old (up to 25 for those with EHC plans). Such children may have a range of barriers to learning, have special educational needs and/or be looked after. It is expected delivery will be mostly within Norfolk, although there may be a need in other local authority areas. On occasion there will be a requirement to support students already in school either where there might be risk of exclusion or where they need additional tutoring to support learning where there may have been gaps in their education or where they are awaiting a school place having moved placement. In the event that coverage across Norfolk under Lot 1 is not sufficient, or insufficient specialist tutors are available, the Council reserves the right to increase the number of suppliers that can be appointed to each lot.
