Tender description

The contract covers the provision of waste management services including collection and disposal from several hospitals and community sites as defined in this notice. In addition to the Trusts listed in phase 1,2 and 3 the following Trusts and or PFI companies may elect to join the contract through the process of change Control Notice: — Derby Teaching Hospitals NHS FT (PFI), — Manchester University Hospitals NHS FT (PFI), — Sherwood Forest Hospitals NHS FT (PFI), — South Tees Hospitals NHS FT (PFI), — Barking, Havering and Redbridge NHS Trust (PFI), — Basildon and Thurrock NHS FT, — Buckinghamshire Healthcare Trust, Stoke Mandeville Hospital (PFI), — Cambridgeshire and Peterborough NHS FT (PFI), — Midland Partnership Haywood Hospitals (PFI), — Wye Valley NHS Trust (PFI). On 5.10.2018, Leeds Teaching Hospital NHS Trust entered into a contract with Mitie to provide clinical waste disposal services to it and a number of NHS Trusts and NHS Foundation Trusts in England. The contract was awarded pursuant to a negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC and on the basis of extreme urgency brought about by events unforeseeable by the Contracting Authority. The incumbent provider for clinical waste services to a number of NHS Trusts and NHS Foundation Trusts was found to be, and continues to be, in breach of environmental permits in respect of a number of its waste storage facilities. The breach posed, and continues to pose, a direct risk to the relevant trusts who have an ongoing duty of care in respect of their waste. The environment agency imposed a partial suspension on 3.10.2018 in respect of the incumbent’s Normanton site which, in the reasonable view of the Contracting Authority, also seriously jeopardised the incumbent’s ability to continue collecting waste from relevant trusts. Attempts to agree remedial plans with the incumbent to clear the site and therefore lift the suspension were unsuccessful. Further environment agency action was anticipated in respect of the incumbent’s other facilities serving trusts who are within the scope of the contract award but who have not yet been provided with services under the contract, these are referred to as phase 2 and 3 as defined below. On the basis of: (a) extreme urgency brought about by events unforeseeable by the Contracting Authority and (b) no tenders and no requests to participate were submitted in response to a previous invitation to tender (see details below) a further competition run under arun under lot 1 b of crown commercial service framework facilities management marketplace RM3830 failed to result in any tenders. Any disruption to waste collection services could potentially have led to the suspension of clinical activities at hospitals and other NHS sites and consequently the contracting authority considers that the use of the negotiated procedure without prior publication and subsequent contract award were necessary due to circumstances of extreme urgency.
