Tender description
The Council proposes to enter into 4 contracts for a maximum period of 5 years with the successful Tenderers (Suppliers). The anticipated contract commencement date is 1.4.2019. The Requirements have been divided into the following work packages (Lots): — Lot 1: Independent Care Act Advocacy (ICAA), — Lot 2: Independent Mental Health Advocacy (IMHA), — Lot 3: Independent Mental Capacity Advocacy (IMCA), — Lot 4: Independent Complaints Advocacy Service (ICAS). This service will assist in the delivery of, and compliance with, the following relevant legislation and guidance: — Care Act 2014, — Mental Health Act 1983, as amended by the Mental Health Act 2007, — Mental Capacity Act 2005, — Code of Practice (Mental Health Act 1983), — The Care and Support (Independent Advocacy) Regulations 2014, — Care and Support Statutory Guidance (Issued under the Care Act 2014), — Equality Act 2010, — Leicestershire County Council, Adult Social Care Strategy 2015-2019, — Rutland County Council, Adult Social Care Strategy 2015-2020, — Leicester City Council Strategic Commissioning Strategy 2015-2019, — Advocacy Code of Practice (Revised Edition 2014). This Service Specification is for the delivery of an Independent Mental Health Advocacy service as a statutory provision under the following relevant legislation and guidance: — Mental Health Act 1983, as amended by the Mental Health Act 2007, — Code of Practice (Mental Health Act 1983), — Mental Capacity Act 2005, — The Care Act 2014, — Care and Support Statutory Guidance (Issued under the Care Act 2014), — Leicestershire County Council, Adult Social Care Strategy 2015-2019, — Leicester City Council, Adult Social Care Strategic Commissioning Strategy, 2015 -2019, — Rutland County Council, Adult Social Care Strategy 2015-2020, — Advocacy Code of Practice (Revised Edition 2014), — The Right to be Heard: Review of IMHA services in England (ULCAN 2012), — Commissioning Independent Mental Health Advocacy services in England (SCIE 2015). This Service Specification is for the delivery of an Independent Mental Capacity Advocacy Service as a statutory provision under the following relevant legislation and guidance: — Mental Capacity Act 2005, — Mental Capacity Act Code of Practice, — The Mental Capacity Act 2005 (Independent Mental Capacity Advocates) (Expansion of Role) Regulations 2006, — DoLS Code of Practice, — Care Act 2014, — Mental Health Act 1983, as amended by the Mental Health Act 2007, — Care and Support Statutory Guidance (Issued under the Care Act 2014), — Leicestershire County Council, Adult Social Care Strategy 2015-2019, — Leicester City Council, Adult Social Care Strategic Commissioning Strategy 2015 – 2019, — Rutland County Council, Adult Social Care Strategy 2015-2020, — Advocacy Code of Practice (Revised Edition 2014), — The European Convention on Human Rights. This Service Specification (“the Specification”) is for the delivery of an Independent Complaints Advocacy Service to residents in Leicester, Leicestershire and Rutland, who need assistance to make a complaint about their NHS care or treatment as a statutory provision under the following relevant legislation and guidance: — Health and Social Care Act 2012, — Mental Capacity Act 2005, — Mental Capacity Act Code of Practice, — The Mental Capacity Act 2005 (Independent Mental Capacity Advocates) (Expansion of Role) Regulations 2006, — DoLS Code of Practice, — Care Act 2014, — Mental Health Act 1983, as amended by the Mental Health Act 2007, — Care and Support Statutory Guidance (Issued under the Care Act 2014), — Leicestershire County Council, Adult Social Care Strategy 2015-2019, — Leicester City Council, Adult Social Care Strategic Commissioning Strategy 2015-2019, — Rutland County Council, Adult Social Care Strategy 2015-2020, — Advocacy Code of Practice (Revised Edition 2014), — The European Convention on Human Rights.
