Tender description
The Delivery Partner is currently appointed to develop new homes on the site of the former Central Ambulance Station site at Marybush Lane, Bristol under an Agreement for Lease awarded on 27.3.2015. The Agreement for Lease was awarded pursuant to the Delivery Partner Panel 2 Framework (South West Lot). The contract for the development of new homes on the site of the former Central Ambulance Station site at Marybush Lane, Bristol was awarded to the Delivery Partner on 27.3.2015, based on the Delivery Partner Panel 2 Framework (South West Lot). The Delivery Partner Panel 2 Framework (South West Lot) was established by the Homes and Communities Agency (HCA) (now Homes England) for the delivery of HCA housing-led developments and schemes procured by the HCA across the range of its land holdings and programmes. The Delivery Partner was appointed to the Delivery Partner Panel 2 Framework (South West Lot) on 18.9.2013. On 21.11.14 the Authority issued an invitation to express interest in the Central Ambulance Station re-development opportunity to the delivery partners appointed to the Delivery Partner Panel 2 Framework (South West Lot). Three delivery partners expressed interest but only the Delivery Partner responded to the invitation to tender. The contract was awarded on 27.3.2015 in the form of an Agreement for Lease (AfL). Following the award of the contract, certain circumstances have arisen which could not have been foreseen when the AfL was entered into. In particular, certain ground conditions and other matters related to the positioning of a culvert have subsequently been discovered at the site, creating viability issues and impacting on programme and cost. As a further consequence of the discovery of the culvert issues, the level of 40 % affordable housing originally proposed by the Delivery Partner has been assessed as unviable. It is now proposed that 20 % is delivered and this requirement forms part of the resolution to grant planning approved on 29.11.2017. It is also proposed that the Delivery Partner be permitted to grant an underlease of the affordable units to a registered provider at golden brick. The Authority is now planning to modify the AfL to deal with these circumstances by extending the delivery programme and reducing the purchase price of the land to take account of deductible costs. In addition, certain amendments which are not substantial are proposed in relation to the structure of sub-lease arrangements. For the reasons set out below, the Authority considers the proposed amendments are permitted under the Public Contracts Regulations 2015 (as amended) (the PCR) and accordingly the Authority is publishing this voluntary notice. The proposed amendments will not be made before the end of a period of at least 10 days beginning with the date after the date of publication of this notice.
