Tender description
To deliver a formal assessment review with assured content to support the council to meet our required statutory responsibilities within the DoH statutory timeframe. The Mental Capacity Act allows restraint and restrictions to be used but only if they are in a person’s best interest. Extra safeguards are needed if the restrictions and restraint used will deprive a person of their liberty, such restrictions need to be assessed and authorised; this can only be implemented by the Local Authority or the Court of Protection. These are called Deprivation of Liberty Safeguards (DoLs). Article 5 of the Human Rights Act states that “Everyone has the right to liberty and security of person, no one shall be deprived of his or her liberty in accordance with a procedure prescribed in law”. The Deprivation of Liberty Safeguards is the procedure prescribed in law when it is necessary to deprive of their liberty a resident or patient who lacks capacity to consent to their care and treatment in order to keep them safe from harm.
