The Council seeks the services of a private enforcement company to issue Fixed Penalty Notices (FPN) for specific environmental offences. The Contractor will be required to provide a minimum of three suitably trained officers (the “Enforcement Officers”) to patrol the areas of the Borough (as may be directed in accordance with paragraph 3 of this Part) and issue FPNs for any offences found to be in breach of the following legislation: • Disposing of Litter (including litter from a moving vehicle and spitting) – Section 87/88 Environmental Protection Act 1990 • Fouling of Land by Dogs & Failure to remove dog faeces from land – Dog Control Order. Section 55 Clean Neighbourhoods and Environment Act 2005 or Failure to remove dog faeces from land – Sections 3(2) & 4 Dogs Fouling of Land Act 1996 • Exposing vehicles for sale on the road - Section 3 & 6 Clean Neighbourhoods & Environment Act 2005 • Repairing vehicles on the road - Section 4 & 6 Clean Neighbourhoods & Environment Act 2005 • Fly-posting - Section 43, 43A & 44 Anti-Social Behaviour Act 2003 • Graffiti - Section 43 & 43A Anti-Social Behaviour Act 2003 • Painting or inscribing upon the surface, a tree, structure or works on the highway - Section 132 (1) Highways Act 1980 • Other environmental legislation and associated offences as the parties may agree in writing from time to time, but subject always to clause 6.2 of the Contract.
