Wiltshire Council has a statutory duty under Section 149 of the Environmental Protection Act 1990 to temporarily kennel stray dogs for 7 clear days following service of notice on the identified owner. Thereafter if the owner does not collect the dog, ownership of the animal legally reverts to the provider who may re-home the dog. Out of the Council's business hours, the service is reliant on the goodwill of the public to take a stray dog to the Council's contracted kennel, situated in Bath, if they cannot keep the dog until the next working day. In reality, however, members of the public will often take a stray dog to a local veterinary practice pending collection either by the council's Animal Health Officers or the dog's owner. At present some vets will take in a stray dog, but are under no obligation to do so. The Council would like to formalise this arrangement with a range of establishments and in return pay a daily rate for the dog's care.
