Tender description

The Council has an annually renewable usage, support & maintenance contract which is needed to maintain the system in operation required to enable the Council to continue to meet its statutory duties and receive crucial bug fixes and statutory upgrades. There is no market for the delivery of support to the software which is a proprietary product. In the absence of a market with alternate suppliers of support the Council is limited to purchasing support services from the incumbent supplier. There is no other supplier that can provide the required level of support and maintenance for this system. The value of the contract in year is below the levels at which the requirement to tender the contract in accordance with EU Procurement Directives is required. Under CPR 11.5.1 where a contract with a value below EU Procurement Directives is procured and only one contractor is able to provide the services for technical or artistic reasons or because of exclusive rights and obtaining them from another contractor would result in incompatibility or disproportionate technical difficulties in operation or maintenance a dispensation from Contract Procedure Rules can be granted provided that continued use represents best value for the Council Keywords: LACHS insurance
