Tender description

MAG awarded a contract to the Supplier on 23.3.2016, for the supply of hold baggage scanning equipment meeting Standard 3 (‘HBS’) plus support and maintenance (‘Contract’). MAG has a time-limited statutory obligation to install HBS at its airports. MAG also arranged an alternative supply of HBS (plus support and maintenance) in March 2016. The alternative arrangement has now been terminated due to a failure to deliver, leaving MAG with a supply gap, arising late in the programmed delivery period. This seriously threatens MAG's ability to meet its statutory obligations. MAG is modifying the Contract to cover the gap and mitigate the impact of the failure. The non-binding indicative forecast in the Contract relates to MAG's airports at Manchester, Bournemouth and East Midlands. To cover the supply gap, MAG has revised that forecast to include additional HBS machines at East Midlands and HBS machines at Stansted, including support and maintenance in both cases. The Contract relates to HBS machines for 4 different applications. In the original procurement procedure, these were divided into 4 lots, but all of the HBS machines to be supplied by the Supplier are included within a single contractual arrangement. The Contract defines the HBS machines and specifies lead times and a purchase order process, with MAG to issue purchase orders in accordance with its requirements for HBS machines. The Contract includes a non-binding indicative forecast of MAG's requirements for HBS machines, delivery dates and delivery locations. However, MAG is entitled to revise the number of machines, delivery dates and delivery locations from time to time. The Supplier must accept all purchase orders issued by MAG. To issue purchase orders in accordance with the revised forecast, MAG considers it necessary to add pricing detail to the Contract to reflect the additional HBS machines at East Midlands and HBS machines at Stansted plus support and maintenance. The Contract relates to HBS machines for 4 different applications.
