Tender description
Pumps. Gas Booster Pumps for Diving Teams. The Under Water and Electronic Warfare Project Team part of the UK Ministry of Defence (‘MoD’), intends to place a contract with Haskel Europe Ltd for the repair and refurbishment of Hand Operated and Air Operated Gas Booster Pumps (the ‘Booster Pumps’) for a period of 7 years from 1.11.2015 to 31.10.2021 (the ‘Support Contract’). It is considered that the Support Contract can be awarded using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of the Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. Reason for Award: The Gas Booster Pumps for Diving Teams were originally off the shelf pieces of kit which have been modified for military use. MoD considers that the safety standards required by the Diving at Work Regulations 1997 can only be achieved by appointing a competent Delegated Design Organisation (namely, the original equipment manufacturer, Haskel) to repair and refurbish the Booster Pumps. Haskel is the only economic entity to have provided support services throughout the service life of the Booster Pumps. If the Support Contract was awarded to a contractor other than Haskel, it would have severe safety issues as that contractor would not have access to the OEM manufacturing Data, the Level 1, 2 Refurbishment and Repair/Maintenance instructions or any original design or information relating to modifications which have been carried out under the current support contract. There is a major risk that due to the specialist and complex technical nature of this equipment, support by any economic entity other than the OEM would significantly increase the risk of a Booster Pump failure which could easily lead to serious injury or fatality. Any economic entity other than Haskel could not give an appropriate level of assurance to the Project Safety Committee, such that the Team Leader who holds the overarching safety critical post for DES Ships (MCS-UEW Team Leader), could endorse the use of these equipments. This notice advises that the MoD has decided to negotiate a contract on a single source basis and is published for reasons of transparency.
