Tender description

Ship Acquisition, part of the UK Ministry of Defence (MOD), intends to place a contract with Liferaft Systems Australia (LSA) for the provision of spare Marine Evacuation System (MES) units consisting of an escape chute and linked life rafts, life rafts and MES training aids consisting of link raft training module, desktop training module and vacuum release pump training units (such components being the ‘Goods’ and such contract being the ‘Contract’). The Goods are manufactured by LSA who are the design authority and original equipment manufacturer. The Contract has an estimated value of 1 400 000 GBP (one million, four hundred thousand pounds) and a duration of 1 (one) year. It is considered that the Contract can be entered into using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(3)(a) of Directive 2009/81/EC of the European Parliament and the Council (Regulation 16(1)(b)(i) of the Defence and Security Public Contracts Regulations 2011). This is because obliging the MOD to procure similar goods from a manufacturer other than LSA would result in the procured goods having different technical characteristics to the Goods, which would result in incompatibility between the existing Goods and any new goods, and would result in disproportionate technical difficulties in operating and maintaining the existing installation which would compromise the integrity of the operational performance of the systems. The MES is a critical safety-to-life ship system and it is required for the ship to operate under SOLAS regulations.
