Tender description

The Mental Capacity Act 2005 (MCA2005) and the associated Deprivation of Liberty Safeguards (DOLS) apply to people who lack capacity to make significant decisions for themselves in relation to care, support, treatment etc., and also on issues about where to live, receiving significant medical treatment and those subject to Safeguarding Vulnerable Adult investigations. The local authority has a responsibility under the MCA as the ‘supervisory body’ to arrange for the necessary assessments to be completed in order to grant an authorisation. A framework for suitably qualified Best Interest Assessors (BIAs) to undertake DOLS is being developed by East Riding of Yorkshire Council.
