Tender description

The contracting authority intends to enter into a contract to transfer land at Riverside House, Leamington Spa for market value to PSP Warwick LLP, for the development of residential dwellings, the proceeds of which will enable the construction by the contracting authority of a new office building, car park and small residential development at Covent Garden, Leamington Spa, having been initially funded by PSP Warwick LLP. The construction of all buildings at Covent Garden will be advertised for tender as a public works contract in the Official Journal. The contracting authority intends to enter into a contract to transfer land to PSP Warwick LLP for market value and this contract is not a public contract, subject to the Directive. PSP Warwick LLP's role in facilitating the entire project (development of land at Riverside House, Leamington Spa and facilitation of new buildings at Covent Garden, Leamington Spa procured by the Council in accordance with the EU procurement rules) arises for the technical reason that it is providing finance and entering into a land transaction, both of which are activities that are not a public works contract or a public services contract.
